Brian’s practice focuses on litigation primarily in the areas of commercial law, intellectual property, bankruptcy and personal injury. Brian has tried jury trials in Delaware’s federal and state courts and bench trials in the Delaware Court of Chancery, United States Bankruptcy Court for the District of Delaware, and other Delaware trial courts.

Brian regularly appears in the United States District Court for the District of Delaware as Delaware Counsel for patent holders and companies involved in patent litigation. Brian has assisted co-counsel in representing clients in a wide range of patent litigation from pharmaceutical to technology-related cases. In addition, he represents creditors and entities involved in litigation in the United States Bankruptcy Court for the District of Delaware. He also litigates business disputes ranging from trade secret claims to breach of contract actions. (See, e.g. R&R Capital, LLC v. Buck and Doe Run Valley Farms, LLC, 2008 WL 3846318 (Del. Ch.)).

Brian is 1 of 15 Delaware lawyers, and less than 1% of U.S. lawyers, admitted to The Million Dollar Advocates Forum in recognition of the substantial recoveries he has obtained on behalf of clients. Working with his brother and partner, J.J., Brian has recovered millions of dollars on behalf of seriously injured people and the families of deceased individuals. Brian has also protected families’ rights when a loved one dies such as in Lawson v. Meconi, 897 A.2d 740 (Del. 2006), where the Delaware Supreme Court held that the autopsy information of a deceased person who dies accidentally is confidential and may not be released to the public.

Brian currently serves on the Lawyer Advisory Committee of the Court of Appeals for the Third Circuit and is a member of the Federal Bar Association, Delaware and Pennsylvania Bar Associations, the Delaware Trial Lawyers Association, and the American Association for Justice.
